GENERAL

Who we are: DAH Holdings Pty Ltd - Part of the Auto Europe LLC Group - ABN 67 107 041 912 ("DriveAway") is a member of The Australian Federation of Travel Agents Limited (AFTA) and the Council of Australian Tour Operators (CATO).

Application: These terms and conditions apply to any contract made between DriveAway and any person (referred to as the "Customer") purchasing goods or services referred to in this brochure from DriveAway.

Quotes: Quotes are valid for 3 days and are in Australian Dollars.

Payment: Prestige Car Hire & Chauffeur & Transfer Services – full payment is required prior to requesting a Prestige Car Rental or Chauffeur / Transfer Service, however if using a credit card, this will not be charged until the vehicle confirmation is received. Credit Card Fees: Where bookings are made by credit card, a surcharge applies. All MasterCard transactions will incur a surcharge of 1.02% on the total amount. All Visa transactions will incur a surcharge of 0.97% on the total amount and American Express transactions will incur a surcharge of 1.81% on the total amount.

Travel Documents: Once the booking is confirmed, a travel voucher will be issued. Please note vouchers are accountable documents and serve as exchange vouchers for products you have booked. Non-presentation of your vouchers may result in charges being applied locally. There are some instances however where documentation is not required. This will be advised at time of reservation.

Amendments: If an amendment occurs, DriveAway reserves the right to re-price. All amendments must be made directly with DriveAway. Conditions apply. In some cases, travel agent charges will also apply.

Reissue Fee: No charge, unless applied by the supplier.

Cancellations: If the booking is cancelled more than 2 weeks prior to collection a cancellation fee of AUD500 plus supplier levied fees (if applicable) will be charged. If a booking is cancelled within 2 weeks prior to collection or is a 'no show', there will be no refund. In some cases supplier levied fees and/or travel agent charges may apply.

Frequent Flyer Points: Not applicable on any DriveAway products.

Refunds: No refund will be made on any part of a package provided and not used. DriveAway does not authorise the employees of any supplier to promise refunds to clients.

Travel Insurance: We strongly recommend that you take out suitable travel insurance with maximum rental vehicle excess cover.

PRESTIGE CAR RENTAL

Vehicle Type: Generally prestige car rental suppliers will guarantee the vehicle model, however there are some exceptions such as Europcar Prestige – UK, Europcar Luxury France, Avis Prestige Germany.

Limited Kilometres: Prestige car rentals are often subject to limited kilometres, as stated on the client’s invoice.

Winter Tyres: For rentals November to March winter tyres may be compulsory for travel to some European countries. We recommend that winter tyres are fitted between November and March when driving to the German, Swiss and Northern Italian Alps. Not available with all vehicle types or all suppliers. Refer to the Terms & Conditions on your voucher or contact DriveAway for further details.

Security Deposit: Generally prestige car rental suppliers require two credit cards for a security bond. Strict conditions apply. Contact DriveAway for details.

Age Limit: Generally the minimum age is 25 years (up to 30 years for some luxury vehicles) but can vary between car rental companies and country. Maximum age limits apply in some countries. A young/senior driver surcharge may apply. Please check at the time of booking.

Drivers Qualifications: Generally, all drivers must hold a full valid drivers licence with a clean driving record for a minimum of one year, however some suppliers require the licence to have been held for a minimum of 3 years. A learner or provisional drivers licence is not accepted. An international licence is required for many countries including Austria, Belgium, Czech Republic, France, Germany, Greece, Italy, Poland and Spain. Fuel: Rates do not include fuel. Vehicles are supplied with a full tank of petrol on collection (exceptions apply). You are advised to refuel your vehicle prior to return and maintain receipts to avoid refuelling charges. Some companies may offer a pre-paid fuel option, which is a pre-determined amount regardless of the amount of fuel remaining upon return of your vehicle. If accepted no refund is available.

Insurance Excess: In the event of theft or accidental damage to the vehicle, an excess will apply. Depending on the prestige model, this can be extremely high. Please enquire at the time of booking. Adequate travel insurance is strongly recommended.

Excess Reduction: In some countries it is possible to purchase additional insurance to reduce the excess amount payable. If the additional cover is accepted, charges are non-refundable.

Optional Accessories: Child seats, ski racks, snow chains, winter tyres, GPS etc should be requested at time of booking and are subject to availability upon arrival. Additional fees apply and are paid locally.

One Way Rentals: If you return your vehicle to a different location than its origin (be it international or domestic), you will incur a one way fee. Charges and conditions vary between suppliers and car types. Details will be advised at time of reservation. If you vary your drop off point, additional charges may apply.

Geographic Restrictions: It is important to advise your Travel Agent and/or DriveAway at time of booking if you intend to drive your rental car outside the country of rental as conditions and charges may apply. DriveAway takes no responsibility for problems occurring as a result of non-advice.

Liability

Liability: Certain provisions of the Competition and Consumer Act (including, without limitation, the Australian Consumer Law) and other State, Territory or Commonwealth laws in Australia, as amended or replaced from time to time, (collectively "ACL") apply to the operation of these terms and conditions and provide consumers (as that expression is used in the ACL) and others with certain rights (referred to collectively as the "consumer guarantees") in relation to goods or services purchased by those persons. Other than consumer guarantees, which are not excluded, modified or restricted by this provision, DriveAway does not give any guarantee or warranty or make any representation of any kind, express or implied, with respect to the supply by DriveAway or others of any goods or services in this brochure. Other than in respect of goods or services supplied to consumers or goods or services that are of a kind ordinarily acquired for personal, domestic or household use or consumption, DriveAway ’ liability for the breach of any condition or warranty, whether express or implied (other than warranties or conditions in relation to title, encumbrances and quiet possession) is limited, at DriveAway option, to:

  1. in the case of goods; the replacement of the goods, the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods; or
  2. in the case of services; the supplying of the services again or the payment of the cost of having the services supplied again.

Subject to rights that the Customer may have under the ACL, which are not excluded, modified or restricted by this provision, DriveAway is not liable to the Customer or any other person, whether in contract, tort or otherwise, for any loss or damages (including without limitation specific, indirect, consequential or economic loss) howsoever caused arising from any event.
Notwithstanding anything contained in this brochure, nothing in these terms and conditions:

  1. excludes, restricts or modifies or purports to have the effect of excluding, restricting or modifying any condition or warranty that is implied by, or consumer guarantee specified by, the ACL or DriveAway's liability under any such condition, warranty or guarantee; or
  2. gives rise to any liability on the Customer’s part or qualifies DriveAway’s liability in circumstances where DriveAway is in breach of these terms and conditions, including any conditions or warranties implied, or consumer guarantees specified, by the ACL.

Responsibility for Information and supply of goods or services by Third Parties

Responsibility for Information: Vehicle specifications, photographs, illustrations, third party charges, third party conditions and information relating to goods or services provided by third parties contained in this brochure (collectively "Information") are provided by third parties to DriveAway. All Information is subject to change without notice. The Customer must not rely on this Information. Any descriptions of the goods or services of any third parties in the Information is by way of identification only and the use or reliance on that description by any person shall not constitute any contract between that person and DriveAway as a sale by description. The Customer must make their own independent enquiries and investigations and undertake their own assessment of any Information before deciding whether or not the goods or services referred to in the Information are suitable for the requirements of the Customer. Without limiting the generality of this paragraph, city maps in this brochure are not to scale and car depot locations in this brochure are approximate only.

Supply of Goods or Services by Third Parties: The goods and services identified in this brochure may be provided by a third party. In order for the Customer to obtain goods and services provided by a third party, the Customer may be required by that third party to agree to, and be bound by, terms and conditions that are specified by that third party. Any person intending to enter into an agreement with a third party must make their own independent enquiries and assessments in relation to the effect of the terms and conditions of that agreement before doing so. Subject to rights that the Customer may have under the ACL, which are not excluded, modified or restricted by this provision, the Customer acknowledges and agrees that DriveAway has no control over and no responsibility for any terms and conditions agreed between the Customer and a third party.

Third Party Liability (Damage outside the vehicle): Provides cover for public liability and is subject to the car rental company’s terms and conditions on the rental agreement. DriveAway strongly recommends travellers purchase travel insurance to cover themselves and their passengers.

Governing Law

These terms and conditions are governed in all respects by the law of the State of New South Wales and the Customer irrevocably submits to the non-exclusive jurisdiction of the Courts of New South Wales and the Federal Court of Australia.
